Software trade secrets: identify the information and the safeguards
A source repository can contain public dependencies, ordinary implementation choices, and valuable confidential know-how together. A focused review identifies the specific information in question and the records supporting how it was kept secret.
Build an information inventory
- Describe the claimed confidential information precisely in an approved private workflow.
- Locate access policies, repository permissions, confidentiality agreements, and offboarding records.
- Separate evidence of acquisition or use from the fact that another product behaves similarly.
Connect safeguards to actual practice
Written policy is one part of the record. Review who could access the material, whether access changed over time, where copies were permitted, and how exceptions were handled. Document gaps without retroactively describing safeguards that did not exist.

Under 18 U.S.C. 1839, trade-secret status involves reasonable secrecy measures and economic value from information not being generally known or readily ascertainable through proper means. Ownership, acquisition, use, and jurisdiction require counsel review.
